1. Agreement to Terms
Welcome to My Food Quest ("Company," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of the My Food Quest website, products, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use the Services.
2. Description of Services
My Food Quest offers an annual membership discount card that provides members with discounts at participating restaurants in Southeast Idaho and reduced pricing for My Food Quest events, including food tours, social nights, food festivals, and other related experiences. Restaurant participation and available discounts are subject to change at any time without notice.
3. Membership Eligibility
Membership is open to individuals who are at least 18 years of age and capable of forming a binding contract. By purchasing a membership, you represent that you meet these requirements. Memberships are non-transferable and may only be used by the individual whose name is associated with the account.
4. Fees and Payment
The annual membership fee is $65.00 USD, payable at the time of enrollment. Fees are subject to change for new or renewed memberships. All payments are processed through third-party payment processors. By submitting payment information, you authorize us to charge the applicable membership fee. No refunds are provided unless required by law or explicitly stated in our cancellation policy.
5. Renewal and Cancellation
Memberships automatically renew for successive one-year terms unless cancelled before the renewal date. You may cancel your membership at any time by contacting us at idahoquests@gmail.com. Cancellation will take effect at the end of the current billing period. No partial refunds will be issued for unused portions of the membership term.
6. Use of Discounts
Members must present a valid My Food Quest membership card or provide the phone number associated with their account at the time of purchase to receive discounts. Discounts are valid only at participating restaurants and events during the active membership period. Discounts cannot be combined with other offers unless explicitly permitted by the participating restaurant. We reserve the right to modify or discontinue any discount at any time.
7. Member Conduct
You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not misuse the membership card, share your account credentials, or engage in fraudulent activity. We reserve the right to suspend or terminate your membership without refund if we determine, in our sole discretion, that you have violated these Terms or applicable law.
8. Intellectual Property
All content, designs, logos, trademarks, and other materials on the Services are owned by or licensed to My Food Quest and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
9. Limitation of Liability
To the fullest extent permitted by law, My Food Quest and its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services, including but not limited to the quality of food, service, or experience at participating restaurants. Our total liability to you shall not exceed the amount paid for your current membership term.
10. Indemnification
You agree to indemnify, defend, and hold harmless My Food Quest and its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Idaho Falls, Idaho.
12. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
